UMER JAN VS State. Ss.302(b), 324 & 34---Co-accused acquitted on same evidence---Effect. Where prosecution evidence treated accused persons equally and no distinction was established regarding role, conviction of one accused could not be maintained after acquittal of co-accused on same evidence. No material evidence existed to distinguish role of petitioner from acquitted co-accused. Appeal allowed and appellant acquitted.
