MUHAMMAD RASHID VS State. Ss. 409, 420, 468 & 471---Prevention of Corruption Act (II of 1947), S. 5(2)---Criminal breach of trust, cheating, forgery and misconduct---Re-appraisal of evidence---Post Office Manual, violation of---Acquittal. Accused persons were civil servants working in Post Office who were convicted and sentenced by Trial Court for offences relating to criminal breach of trust, cheating, forgery and misconduct. Validity---The matter was shrouded in mysteries and doubts. Even during inquiry proceedings, the proper procedure prescribed under the Post Office Manual was not followed, which was also noticed by the High Court. Prosecution failed to prove its case against the accused persons beyond any shadow of reasonable doubt. Supreme Court set aside the conviction and sentence awarded by the Trial Court and acquitted the accused persons. Appeal was allowed in circumstances.
