FIAZ ALIAS MANSHA VS State. Sections 302(b) & 34, Pakistan Penal Code, 1860---Anti-Terrorism Act (XXVII of 1997), Section 7---Qatl-i-amd, common intention, act of terrorism---Reappraisal of evidence---Recovery of weapon of offence and motorcycle---Reliance---Scope. Accused were charged for committing murder of brother of complainant. Petitioners-convicts were arrested on 14.08.2015 by Investigating Officer and from personal search of each accused, .30 bore pistol was recovered. Similarly, motorcycle without number plate allegedly used in commission of offence, which petitioners-convicts were riding at the time of arrest, was also taken into possession. Held: In such circumstances, conviction of petitioner-convict "F" recorded through impugned judgment was maintained, however, his death sentence was commuted to imprisonment for life. Conviction and sentence of remaining petitioners-convicts did not warrant any interference. Petition was converted into appeal and partly allowed.
