Ch. BASHIR AHMAD VS QAMAR AFTAB. S.19---Specific Relief Act (I of 1877), S.56---Ejectment proceedings---Stay of---Execution of decree. Appellant/landlord filed ejectment application against respondent/tenant regarding factory premises. Respondent claimed to be director of company who had participated in auction and being highest bidder was not under obligation to pay rent until his bid was refused conclusively by High Court. Held: It was not fair to comment whether respondent was under obligation to pay rent as relationship between parties was yet to be decided by Rent Controller. Courts below had misdirected themselves when they got influenced by order of status quo which could not influence rent proceedings as such proceedings were independent in nature. Supreme Court set aside orders and remanded matter to Rent Controller with direction to decide applications for leave to appear and defend first and thereafter decide relationship between landlord and tenant. Appeal was disposed of.
