GHULAM MURTAZA VS DISTRICT POLICE OFFICER, GUJRAT Civil service---Dismissal from service---Departmental proceedings founded solely on criminal case---Effect of acquittal--- Supreme Court held that where departmental action was based only on registration or pendency of FIR and no independent misconduct was alleged, acquittal in criminal case removed the very basis of departmental proceedings. Penalty of dismissal was held legally unsustainable and employee was reinstated.
