MUHAMMAD AMJAD VS State. Ss.302(b), 148 & 149---Qatl-i-amd, rioting armed with deadly weapons, unlawful assembly. Reappraisal of evidence---Benefit of doubt---Unnatural conduct of eye-witnesses. Alleged eye-witnesses were brother and cousin of deceased but neither intervened to rescue deceased nor raised alarm to attract people. They also did not attribute firing at themselves despite being present at spot and having common motive. Their passive conduct and escape from five armed accused persons created serious doubt regarding their presence. Sequence of deceased running after initial shot, being chased and then collectively fired upon by five assailants without injury to any accused or any stray bullet hitting another person was highly improbable. Prosecution failed to establish guilt beyond reasonable doubt. Appeal against conviction was allowed.
