SHAHBAZ KHAN VS DOWLAT KHAN. O.XX, R.18---Partition of property---Preliminary decree. In partition suits, Court may issue preliminary decree when physical partition cannot conveniently be carried out without further inquiry. Preliminary decree determines and declares rights and shares of parties. Actual division of property takes place at final decree stage. Trial Court committed serious omission by failing to specify shares of parties in preliminary decree.
